The decision of the Tribunal was as follows:-
Determination
The Tribunal is satisfied that all parties were on notice of the hearing. As there was no appearance by or on behalf of the respondent the Tribunal heard the appellant’s uncontested evidence. The appellant was employed by the respondent since August 2011 in the role of administrator and marketing executive.
On 14 April 2014 the appellant learned that teachers employed by the respondent company had not received their wages. Later that night the director of the respondent company emailed her informing her that the college was closing down. The appellant received no redundancy payment.
The Tribunal is satisfied that the appellant’s employment ended by way of the business closing down making her redundant. The Tribunal awards the appellant a redundancy lump sum under the Redundancy Payments Acts, 1967 to 2007 based on the following details:
Date of Commencement: 30 August 2011
Date of Termination: 14 April 2014
Gross Weekly Pay: €687.50
This award is made subject to the appellant having been in insurable employment under the Social Welfare Acts during the relevant period.
It should be noted that payments from the Social Insurance Fund are limited to a maximum of €600.00 per week.
