The decision of the Tribunal was as follows:-
This case came before the Tribunal by way of the employer appealing the recommendation of a Rights Commissioner under the Terms of Employment (Information) Act, 1994 and 2001 ref R-131477-TE-13/EH.
Determination
The Tribunal is satisfied that all parties were properly on notice of the hearing.
There was no appearance or representation for the appellant. His wife made an application to have the Hearing postponed while informing the Tribunal that she was not in attendance to represent the appellant.
The Tribunal refused the application to postpone the Hearing. The appeal of the recommendation of the Rights Commissioner under the Terms of Employment (Information) Acts 1994 and 2001 fails for want of prosecution and the recommendation of the Rights Commissioner is upheld.
