The determination of the Tribunal was as follows:-
The claimant’s solicitor advised the Tribunal that her company had written to a town agent asking that they seek an adjournment for the hearing. No application was ever received by the Tribunal and there was no follow up between solicitor and town agent. The claimant was not in attendance.
Counsel for the respondent asked that the matters before the Tribunal be struck out for want of prosecution. The Tribunal was mindful that a right of appeal lies to the Circuit Court.
In the circumstances the Tribunal dismiss the claim under the Unfair Dismissals Acts, 1977 to 2007, the Minimum Notice and Terms of Employment Acts, 1973 to 2005 and the Redundancy Payments Acts 1967 to 2007.
