The determination of the Tribunal was as follows:-
Background:
The respondent accepted the claimant had been dismissed. As this is the case the claimant gave sworn evidence of the mitigation of her losses since her dismissal. She was employed from the 1st May 2011 to the 12th August 2013 and paid a monthly gross wage of €1,700.00.
A liquidator was appointed to the company on the 20th July 2015.
Determination:
As the respondent failed to adduce evidence to show substantial grounds of why the claimant was dismissed, the dismissal is deemed as unfair as set out in Section 6 of the Unfair Dismissals Act.
Having heard the sworn evidence form the claimant regarding loss the Tribunal awards the sum of €18,000.00 under the Unfair Dismissals Acts, 1977 to 2007.
