The decision of the Tribunal was as follows:-
Determination:
The liquidator conceded the claimant was entitled to the balance of his minimum notice payment owed, this being two weeks’ gross wages. The claimant has already received six of the eight weeks minimum notice payment he is entitled to.
Accordingly, the Tribunal awards the sum of €1,672.60, this being two weeks gross wages, under the Minimum Notice and Terms of Employment Acts, 1973 to 2005.
It should be noted that a statutory weekly ceiling of €600.00 currently applies to payments from the Social Insurance Fund. This award is made subject to the appellant fulfilling current social welfare requirements in relation to PRSI contributions.
