The determination of the Tribunal was as follows:-
Determination:
The Tribunal is satisfied that the respondent was properly notified of the date, time and location of the hearing of this matter. Neither they nor a representative on their behalf attended on the day. Having waiting a period of 20 minutes after the scheduled commencement time allotted for this hearing, the Tribunal commenced hearing this matter at 2.50p.m.
Having heard and considered the uncontested evidence of the appellant the Tribunal is satisfied his employment was terminated by the respondent without proper notice. Accordingly the appeal under the Minimum Notice and Terms of Employment Acts, 1993 to 2005 is allowed and the appellant is awarded €299.38 as compensation for one weeks’ notice.
The Tribunal also awards the sum of €299.38, this being five days annual leave under the Organisation of Working Time Act, 1997.
These awards are made subject to the appellant having been in insurable employment under the Social Welfare Acts during the relevant period.
