Determination:
Neither the respondents nor a representative on their behalf attended the hearing. Notification of the hearing was delivered to a trading address provided by the appellant. It was the appellant’s uncontested evidence that her employment ceased without notice due to the closure of one of the respondents’ premises and that she had not received the redundancy payment due to her. The Tribunal is satisfied based on the appellant’s uncontested evidence that she is entitled to a lump sum payment under the Redundancy Payments Acts, 1967 to 2007, based on the following criteria:
Date of Commencement: 27 September 2011
Date of Termination: 2 May 2014
Gross Weekly Pay: €216.25
This award is made subject to the appellant having been in insurable employment under the Social Welfare Acts during the relevant period.
The Tribunal also finds that the appellant is entitled to the sum of €432.50 (being the equivalent of two weeks’ gross pay) under the Minimum Notice and Terms of Employment Acts, 1973 to 2005.
