The decision of the Tribunal was as follows:-
There was no appearance by or on behalf of the respondent. The respondent is in Liquidation/Receivership.
Based on the uncontested evidence of the appellant the Tribunal is satisfied that he was dismissed by reason of redundancy. Accordingly the Tribunal awards the appellant a lump sum payment under the Redundancy Payments Acts 1967 to 2007 based on the following information:
Date of commencement of employment: 1 May 2010
Date of termination of employment: 9 May 2014
Gross weekly pay: €181.65
The appellant is also due entitlements under the Organisation of Working Time Act, 1997, in respect of 15 days holidays outstanding at the time of termination of employment. The Tribunal therefore awards the appellant the sum of €908.25 under the Act.
Allowing the claim lodged under the Minimum Notice and Terms of Employment Acts, 1973 to 2005, the Tribunal awards the appellant the sum of €363.30 (this amount being equivalent to two weeks’ gross pay at €181.65 per week).
