The decision of the Tribunal was as follows:-
The appellant’s employment ended in 2007 following an accident. He continued to discuss a return to work with the respondent but was told that there was no work currently but to hang on and see if things improved economically. He did not receive a P45.
His claim for redundancy was submitted to the Employment Appeals Tribunal on the 13 November 2014 outside the statutory time limit for bringing a claim.
Having considered the evidence submitted the Tribunal is not satisfied that the appellant demonstrated that reasonable circumstances outside of his control led to the late submission of his claim.
The appeal under the Redundancy Payments Acts, 1967 to 2007 fails.
