The decision of the Tribunal was as follows:-
This case came before the Tribunal by way of an appeal by the employer (appellant) against the recommendation of the Rights Commissioner (r-139755-te-13/EH) under the Terms of Employment (Information) Act, 1994 and 2001.
The appellant’s representative provided oral and documentary evidence to the Tribunal. Based on this uncontested evidence the Tribunal finds in favour of the appellant and therefore upsets the decision of the Rights Commissioner.
