This case was heard along with an appeal by the respondent employer under the Protection of Employees on Transfer of Undertakings Regulations 2003. No evidence was adduced by the claimant in relation to his notice entitlements. Accordingly the claim under the Minimum Notice and Terms of Employment Acts 1973 to 2005 fails and is hereby dismissed.
