The decision of the Tribunal was as follows:
Having heard and considered the uncontested evidence of the appellant the Tribunal finds his employment with the respondent was terminated by way of redundancy. Accordingly, the appeal under the Redundancy Payment Acts, 1967 to 2007 succeeds and the appellant is awarded a statutory lump sum under those Acts and based on the following:
Date of Commencement: 10 June 2008
Date of Termination: 27 March 2014
Gross Weekly Wage: €180.50
The appeal under the Minimum Notice and Terms of Employment Acts, 1973 to 2005 is allowed and the appellant is awarded €722.00 as compensation for his statutory notice.
The Tribunal also allows the appeal under the Organisation of Working Time Act, 1977 and awards the appellant €469.30 as compensation for outstanding leave entitlements.
