This case came before the Tribunal by way of an appeal against the decision of a Rights Commissioner Ref: R-132034-tu-13.

Determination:

The respondent did not attend the Rights Commissioner hearing nor the appeal hearing before the Tribunal. From the uncontested evidence of the appellant the Tribunal upholds the decision of the Rights Commissioner (that this was not a transfer within the meaning of the Regulations) therefore affirming that a Redundancy situation clearly existed with the above named respondent.
