The determination of the Tribunal was as follows:-
This case came before the Tribunal by way of the employer (the appellant) appealing against the recommendation of the Rights Commissioner ref. r-138337-ud-13/JT.
Determination:
The employer (appellant) withdrew this appeal prior to the hearing of this case.
The employee (respondent) in his response on Form T2B to the employer’s appeal sought implementation of the Rights Commissioner Recommendation.
The employer (appellant) was on notice of this, therefore the Tribunal exercises its jurisdiction and makes a determination to the like effect as the Rights Commissioner recommendation r-138337-ud-13/JT that the appellant (the employer) pay the respondent (the employee) the sum of €25,000.00 under the Unfair Dismissals Acts, 1977 to 2007.
