The determination of the Tribunal was as follows:-

This case came before the Tribunal by way of the appellant (the employee) appealing against the recommendation of the Rights Commissioner under the Unfair Dismissals Acts, 1977 to 2007 ref. r-138913-ud-13/JT.

Determination:

This case came before the Tribunal whereby the appellant was appealing against the recommendation of the Rights Commissioner. The recommendation of the Rights Commissioner was dated 26^th March 2014 and the Notice of Appeal was filed with the Tribunal on 2^nd May 2014.

The Notice of Hearing was sent to the appellant at his home address by registered post on 17^th June 2015 and was signed for by a family member on 18^th June 2015.

The Tribunal is satisfied that the appellant was duly notified of the hearing. Neither the appellant nor a representative on his behalf appeared at the hearing.

Accordingly, the Tribunal dismisses the appeal and upholds the recommendation of the Rights Commissioner under the Unfair Dismissals Acts, 1977 to 2007.
