This case came before the Tribunal by way of an employee appealing the recommendation of a Rights Commissioner under the Unfair Dismissals Acts, 1977 to 2007, ref: r-140716-ud-13/JT.
The determination of the Tribunal was as follows:-
There was no appearance by the appellant at the hearing. The appellant’s representative confirmed that the appellant was aware of the date and time of the hearing but he had indicated to her on the previous evening that he did not intend to appear at the hearing. The appellant’s representative had no further instructions from her client.
Determination:
There was no appearance by the appellant. The Tribunal is satisfied that the appellant was on notice of the hearing. The Tribunal dismisses the appeal made under the Unfair Dismissals Acts, 1977 to 2007, for want of prosecution. Accordingly, the Rights Commissioner recommendation (ref: r-140716-ud-13/JT) stands.
