Procedure:
On the 8th October 2015, the complainant referred a complaint to the Workplace Relations Commission, seeking redress pursuant to the Terms of Employment (Information) Act. The complaint was referred to adjudication on the 9th March 2016.It became apparent that at the scheduled time for the adjudication to commence, there was no appearance by or on behalf of the complainant. Aidan Phelan of Peninsula Business Services was in attendance for the respondent and was accompanied by the respondent Regional Manager and the manager of the facility where the complainant worked.
I waited for some time to see whether the complainant had been delayed in arriving at the venue of the adjudication and also confirmed that he had been issued with notice of the adjudication. Having so waited and satisfied in relation to the service of the notice, I proceeded with the adjudication in the absence of the complainant.
Given that the complainant did not attend to prosecute his complaint, the complaint fails for want of prosecution.

Decision:
Section 41(4) of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
Given that the complainant did not attend the adjudication, hiscomplaint fails for want of prosecution.
