Procedure:
In accordance with Section 41(4) of the Workplace Relations Act, 2015 and Section 6 of the Payment of Wages Act, 1991, and following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background
The Complainant was employed from 31st August 2015 until 30th September 2015. The Complainant stated that he was paid €650.00 net per week and he worked 47.5 hours a week. The Complainant referred a complaint to the Workplace Relations Commission on 15th October 2015 alleging his Employer had breached Section 5 of the Act in that he had not been paid his wages of €1100.00 on 6th October 2015. |
Summary of Complainant’s Position.
The Complainant stated that his wages were paid into his Bank Account each week but he did not receive a payslip. He requested same but these were never provided to him. He served one weeks notice to leave the employment but he was not paid for the last 8 days of his employment. The Complainant stated that he had made numerous attempts to recover his wages from his Employer but there was no response. The Complainant provided copies of emails sent to his former Employer.
He is claiming payment of €1100.00 in respect of 8 days wages due and not paid to him on termination of the employment.

Decision:
Section 41(4) of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
Decision:
In accordance with Section 41(4) of the Workplace Relations Act, 2015 and Section 6 (2) of the Payment of Wages Act, 1991, and on the uncontested evidence of the Complainant, I declare the complaint is well founded .
I order the Respondent to pay the Complainant the sum of €1100.00 , subject to any lawful deductions, within six weeks of the date of this Decision.
