Procedure:
On the 22nd October 2015, the complainant referred a complaint pursuant to the Workplace Relations Act, seeking redress under the Payment of Wages Act. The complaint was scheduled for adjudication on the 4th March 2016.
The complainant attended the adjudication in person. There was no appearance by or on behalf of the respondent company. I verified that the respondent was on notice of the adjudication hearing and having been satisfied of this, I proceeded with the adjudication in the absence of the respondent.
In accordance with Section 41(4) of the Workplace Relations Act, following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Complainant’s Submission and Presentation:
The complainant outlined that she commenced employment on 12th August 2015 and this came to an end on 14th October 2015. She worked 39 hours per week and her remuneration was €450 per week. She outlined that the respondent operates a website advertising services related to weddings. She held an administrative role. On the 14th October 2015, she received a text message from a director of the respondent to say that her employment was coming to an end and that she would be paid for her last week of work, i.e. the week of the 12th to the 16th October 2015. She said that these monies were never paid to her and she is seeking redress in this regard.
Respondent’s Submission and Presentation:
The respondent did not attend the adjudication and did not make submissions to it.
Findings and reasoning:
I find as fact that the complainant is entitled to her pay for the week of the 12th to the 16th October 2015 (an amount of €450) and that these monies were not paid to her. I therefore determine that the respondent shall pay to the complainant the amount of €450.
Decision:
Section 41(4) of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
This decision provides that the respondent shall pay to the complainant the amount of €450.
