Complaint seeking adjudication by the Workplace Relations Commission under Section 8 of the Unfair Dismissals Act 1977 | CA-00000667-001 | 06/11/2015 |
Date of Adjudication Hearing: 02/02/2016
Workplace Relations Commission Adjudication Officer: Aideen Collard
Procedure:
In accordance with the relevant provisions of the Workplace Relations Act 2015 and/or Section 8 of the Unfair Dismissals Acts 1977 (as amended), following the referral of this complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Complainant’s Submission and Presentation:
The Complainant submitted a complaint to the Workplace Relations Commission under Section 8 of the Unfair Dismissals Act 1977 (as amended), that he had been unfairly dismissed by the Respondent for not providing his registration details despite furnishing all requested information. On his complaint form, he indicated that he had commenced employment on 9th September 2015 and ceased employment on 16th October 2015 and also that: “I do not have at least 12 months service.” |
The Complainant did not attend the hearing of his complaint herein which commenced as scheduled at 1pm and concluded at 1.40pm. I am satisfied that the Complainant was properly notified in writing of the location, time and date of the hearing at the address provided and further, that he did not contact the Workplace Relations Commission to indicate any difficulty attending or seek an adjournment. The Complainant therefore did not proffer any evidence in support of his complaint.
Decision:
I find the Complainant’s non-attendance at the hearing to pursue his complaint unreasonable having regard to all the circumstances and therefore dismiss his claim for lack of prosecution.
