Procedure:
On the 30th November 2015, the complainant referred complaints in relation to alleged breaches of the National Minimum Wage Act, the Payment of Wages Act and the Organisation of Working Time Act. The complaints were scheduled for adjudication on the 23rd March 2016.
In accordance with Section 41(4) of the Workplace Relations Act, 2015 following the referral of the complaints to me by the Director General, I inquired into the complaints and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaints.
Complainant’s Submission and Presentation:
At the time the adjudication was scheduled to commence, it became apparent that there was no appearance by or on behalf of the complainant. I waited for some time to see whether the complainant had been delayed in arriving at the venue of the adjudication and also confirmed that he had been issued with notice of the adjudication. Having waited and also satisfied in relation to the confirmation of notice, I proceeded with the adjudication in the absence of the complainant. Given that the complainant did not attend to prosecute his complaint, the complaint fails for want of prosecution.

There was no appearance by or on behalf of the respondent.
Decision:
Section 41(4) of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaints.
Given that the complainant did not attend the adjudication, his complaint fails for want of prosecution.
