(Division of Tribunal)
Chairman: Ms S. McNally
Members: Mr D. Hegarty
Mr D. McEvoy
heard this appeal at Cork on 3rd March 2016
Representation:
Appellants : In person
Respondent : Gerard Murphy & Co., 46 St Marys Road, Midleton, Co. Cork
The decision of the Tribunal was as follows:
The workplace Relations Customer Service received applications for all appellants on 15 December 2014. All gave their date of termination as March 2013. Following a submission of this timetable the Tribunal applied the “reasonable cause” to these cases and allowed the appeals to proceed.
Having heard and considered the circumstances of this case for all the appellants the Tribunal is satisfied that the employments of all the appellants were terminated by reason of redundancy. Accordingly, the appeals under the Redundancy Payments Acts, 1967 to 2007 are allowed and each appellant is awarded a statutory lump sum under those Acts, and based on the following:
Name Date of Commencement Date of Termination Gross weekly Wage
Chris Cross 02 Nov. 2009 29 Mar. 2013 €439.14
Aron McGrath 24 May 2010 29 Mar. 2013 €512.00
Damien Mullen 18 Sep. 2009 29 Mar. 2013 €499.00

Pat Dineen 02 Nov. 2009 29 Mar. 2013 €512.00
These awards are made subject to the appellants being in insurable employment in accordance with the appropriate legislation during the relevant period.
A weekly statutory ceiling of €600.00 applies to payments from the Social Insurance Fund.
