The decision of the Tribunal was as follows:-
The appellant commenced employment with the respondent company in January 2003 in the role of lorry driver He gave evidence of being laid off in August 2014 and of serving an RP9 on the respondent in October 2014. The respondent’s records showed that the appellant had only worked for 13 weeks during 2014.
The Tribunal is satisfied that the appellant’s employment ended by way of redundancy. The Tribunal awards the appellant a redundancy lump sum payment under the Redundancy Payments Acts, 1967 to 2007 based on the following details:
Date of Commencement: 1 January 2003
Date of Termination: 11 August 2014
Gross Weekly Pay: €500.00
This award is made subject to the appellant having been in insurable employment under the Social Welfare Acts during the relevant period.
