EMPLOYMENT APPEALS TRIBUNAL
APPEAL OF: CASE NO.
Linda Christina Keating RP935/2014
Against
Cornerstone Engineering Limited (In Liquidation)
under
REDUNDANCY PAYMENTS ACTS 1967 TO 2007
I certify that the Tribunal
(Division of Tribunal)
Chairman: Ms S. McNally
Members: Mr D. Hegarty
Mr D. McEvoy
heard this appeal at Cork on 3rd March 2016
Representation:
Appellant: In person
Respondent : Gerard Murphy & Co., 46 St Marys Road, Midleton, Co. Cork
The decision of the Tribunal was as follows:
The appellant’s application under the Redundancy Payments Acts, 1967 to 2007 was received by the Workplace Relations Customer Service on 03 December 2014. This was in excess of 52 weeks from her date of termination but less than 104 weeks from that event. Following an explanation for this timescale the Tribunal allowed “reasonable cause” to apply and proceeded to hear the case.
Having heard and considered the brief submissions from the appellant and the liquidator the Tribunal is satisfied that the appellant’s employment with the respondent ceased by way of redundancy. Accordingly, the Tribunal allows the appeal under the Redundancy Payments Acts, 1967 to 2007 and the appellant is awarded a statutory lump sum under those Acts, and based on the following:
Date of Commencement: 10 March 2008
Date of Termination : 05 April 2013
Gross Weekly Wage: €499.00
This award is made subject to the appellant being in insurable employment and in accordance with the appropriate legislation during the relevant period.
Sealed with the Seal of the
Employment Appeals Tribunal
