Procedure:
In accordance with Section 41(4) of the Workplace Relations Act, 2015 and the abovementioned Act, following the referral of the complaint(s)/dispute(s) to me by the Director General, I inquired into the complaint(s)/dispute(s) and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint(s)/dispute(s).
Complainant’s Submission and Presentation:
During my employment with the respondent i was constantly waiting to get paid,i finished working with then on 15th may of this year and was told i would be paid my outstanding wages over the next few weeks, which never happened, i was told the restaurant was taken back from the landlord,i have heard nothing from Mr. H since |
The complainant worked for the respondent in the period 26th of October 2014 until the 15th of May 2015. She was paid €350 net and worked 35 hours per week.
The complainant submits that she was owed wages properly payable under the Act in the amount of €1,500 net. They included outstanding holiday entitlement, arrears and payment due in respect of her promotion to the position of supervisor. It was acknowledged by the respondent that the wages were owed.
Decision:
Based on the uncontested evidence adduced at hearing I find that the complaint is well founded and hereby require that the respondent pay the claimant €1,500 (say one thousand five hundred euro) net in compensation.
