Procedure:

In accordance with Section 41(4) of the Workplace Relations Act, 2015 under Section 39 of the Redundancy Payments Act, 1967 under Section 11 of the Minimum Notice & Terms of Employment Act, 1973 following the referral of the complaints to me by the Director General, I inquired into the complaints and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaints.

Background

The Complainant was employed as a General Operative from 17^th December 2012 to 16^th December 2014. He was paid €718.00 per week. He has sought statutory redundancy payment and minimum notice.

Respondent’s Submission and Presentation

The Respondents were in attendance and submitted a written submission. However they were not requited to respond as no complaint was presented.

Finding

I find that the Complainant did not attend and did not present a complaint.

Decision:

Section 41(4) of the Workplace Relations Act 2015, under Section 39 of the Redundancy Payments Act, 1967 and under Section 11 of the Minimum Notice & Terms of Employment Act, 1973 requires that I make a decision in relation to the complaint(s)/dispute(s) in accordance with the relevant redress provisions under Schedule 6 of that Act.

I have decided that as no complaint was presented the claims fail for want of prosecution.
