Workplace Relations Commission Adjudication Officer: Peter O'Brien
Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaint(s)/dispute(s) to me by the Director General, I inquired into the complaint(s)/dispute(s) and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint(s)/dispute(s).
Complainant’s Submission and Presentation:
|
The Complainant was employed as a Sales Assistant from M ay 13th 2013 to February 14th 2016.
She was made redundant when the Supermarket closed. She was asked would she move to other locations over 100 miles away. This was not practical for the Complainant. She was earning on average 280.58 Euro per week.
Respondent’s Submission and Presentation:
The Respondent was not present at the Hearing.
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint(s)/dispute(s) in accordance with the relevant redress provisions under Schedule 6 of that Act. The Complainant was employed for approximately 2 years and 9 months. Her employment was terminated by reason of redundancy and under the Redundancy Payments Act, 1967 and subsequent amendments the Complainant is entitled to two weeks per years of service plus a week. I estimate this to be approximately 1,823 .77 Euro based on the Complainants average 2015 salary per week. This amount should be paid to the Complainant within six weeks of the date of this decision.
