1. Unfair procedures and Dismissal
BACKGROUND:
2. On the 27 May 2016, the Worker referred the dispute to the Labour Court in accordance with Section 20(1) of the Industrial Relations Act, 1969 and agreed to be bound by the Court's Recommendation. A Labour Court hearing took place on the 2 August 2016. The Employer did not attend the hearing.
RECOMMENDATION:
The Court notes that the Respondent Company decided not to attend the hearing.
Having given careful consideration to the uncontroverted submissions of the Complainant the Court finds that the Respondent Company failed in its dealing with him to comply with the terms if Statutory Instrument No. 146/2000.
In these circumstances the Court finds that the Complainant was unfairly treated by the Respondent Company and recommends that it pay him compensation in the sum of €7,500 in full and final settlement of all matters arising in this case.
The Court so recommends.
