The determination of the Tribunal was as follows:-
There was no appearance by or representation on behalf of the Liquidator. The Tribunal is satisfied that he was on notice of the hearing. The claimant was one of many who was dismissed without notice when respondent the ceased operating its business in a chain of filling stations around the country.
Determination:
The claimant withdrew his claim under the Unfair Dismissals Acts, 1977 to 2007.
The Tribunal is satisfied that a redundancy situation occurred and that the claimant is entitled to a redundancy lump sum payment under the Redundancy Payments Acts, 1967 to 2007, based on the following information:
Date of Commencement: 2 January 2011
Last Day Worked: 28 February 2014
Date of Termination: 28 February 2014
Gross Weekly Pay: €325.00
Loss having been established the Tribunal award the sum of €650.00, this being two weeks’ gross wages, under the Minimum Notice and Terms of Employment Acts, 1973 to 2005.
The Tribunal also awards the sum of €162.50 under the Organisation of Working Time Act, 1997.
These awards are made subject to the appellant having been in insurable employment under the Social Welfare Acts during the relevant period.
