The decision of the Tribunal was as follows:-
There was no appearance by or representation on behalf of the Liquidator. The Tribunal is satisfied that he respondent was on notice of the hearing. The claimant was one of many who was dismissed without notice when the ceased operating its business in a chain of filling stations around the country.
Determination:
The claimant withdrew her claim under the Unfair Dismissals Acts, 1977 to 2007.
The claimant commenced employment with the respondent on the 18th of September 2013 and her employment terminated on the 24th February 2014.
An employee must have two years continuous service in order to take a claim under the Redundancy Payments Acts, 1967 to 2007. Therefore without the required service the Tribunal are statute barred from hearing this claim.
