Procedure:
In accordance with Section 41(4) of the Workplace Relations Act, 2015 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background
The Complainant was employed as a General Operative from 24th January 2015 to 13th November 2015. She was paid €8.65 per hour and worked 40 hours per week. She has claimed that she did not her annual leave entitlement.
Complainant’s Submission and Presentation:
The Complainant did not attend and no case was prosecuted.
Respondent’s Submission and Presentation:
As no complaint was prosecuted the Respondent was not required to give evidence.
Findings
I note that there is correspondence on file advising the complainant of the date, time and venue of the hearing.
I note that the Complainant did not attend, was not represented and did not prosecute her complaint.
Decision:
Section 41(4) of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
I have decided that this complaint fails for want of prosecution.
