The decision of the Tribunal was as follows:-
The claimant was dismissed for gross misconduct but the Tribunal found (UD1064.14) that she was unfairly dismissed.
Determination:
Given that the claimant had some nine-and-a-half years’ service when dismissed without notice, the Tribunal, in allowing her claim under the Minimum Notice and Terms of Employment Acts, 1973 to 2005, awards her the sum of €1330.56 (this amount being equivalent to four weeks’ gross pay at €332.64 per week) under the said legislation.
