The decision of the Tribunal was as follows:-
The appellant provided documentation to the Tribunal which supported the claim that the respondent was his employer. A notice of hearing had issued by registered post to the two addresses for the respondent as per the Companies Registration Office. The registered post was returned from one of the addresses marked “not called for” and was subsequently re-issued by ordinary post. Neither the respondent nor a representative on his behalf attended the hearing.
Based on the appellant’s uncontested evidence the Tribunal finds that the appellant is entitled to a lump sum payment under the Redundancy Payments Acts, 1967 to 2007, based on the following criteria:
Date of Commencement: 1 February 2005
Date of Termination: 14 January 2014
Gross Weekly Pay: €217.10
This award is made subject to the appellant having been in insurable employment under the Social Welfare Acts during the relevant period.
