This case came before the Tribunal as a request for Implementation of the recommendation of the Rights Commissioner reference r-150516-ud-14/MH under the Unfair Dismissals Acts 1977 to 2007.

The determination of the Tribunal was as follows:-

The employee in this case seeks the Implementation of the Rights Commissioner recommendation, however because the employer has appealed the Rights Commissioner recommendation, the Tribunal has no jurisdiction to make an Order for Implementation.

The request to Implement is denied.
