Determination:
The Tribunal are satisfied the respondent company was properly notified of the date, time and location of the hearing which was sent to its registered office but failed to appear at the hearing.
Under Section 39 of the Organisation of Working Time Act, 1997 the Tribunal amended the title of the respondent to reflect it as a limited company. This is the correct title registered with the Companies Registration Office and the title cited on the appellant’s payslips and tax credist documentation from the Revenue Commissioners.
The Tribunal finds that the appellant is entitled to a lump sum payment under the Redundancy Payments Acts, 1967 to 2007, based on the following criteria:
Date of Commencement: 1 March 2005
Date of Termination: 2 August 2013
Gross Weekly Pay: €686.14
This award is made subject to the appellant having been in insurable employment under the Social Welfare Acts during the relevant period. It should be noted that a ceiling of €600.00 applies to payments from the Social Insurance Fund.
