The decision of the Tribunal was as follows:-
This case came before the Tribunal where the appellant was seeking implementation of the recommendation of the Rights Commissioner under the Unfair Dismissals Acts, 1977 to 2007 (reference r- 141581-ud-13/RG).
Background:
The appellant lodged a claim for unfair dismissal to the Rights Commissioner on the 20th December 2013. The Rights Commissioner heard the matter and issued a recommendation in favour of the claimant awarding her the sum of €12,000 on the 2nd July 2014.
On the 24th October 2014 the appellant’s representative lodged a T1D form to the Employment Appeals Tribunal to have the recommendation of the Rights Commissioner implemented.
However, on the 31st July 2014 the respondent company lodged a T1B form to appeal the Rights Commissioners recommendation (reference – UD1530/2014). This was followed on the 24th October 2014 with a copy of the Rights Commissioners recommendation.
In this instance the appeal of the recommendation of the Rights Commissioner in this matter was received within the six week time limit.
Determination:
The Tribunal determines that as the appeal of the Rights Commissioners was received within the time limit this appeal to implement the Rights Commissioner is struck out.
