This case came before the Tribunal by way of an employee seeking to implement a recommendation of a Rights Commissioner under the Unfair Dismissals Acts, 1977 to 2007, ref: r-132148-ud-13/JC and a recommendation under the Terms of Employment (Information) Act, 1994 to 2012, ref: r-129972-te-13/JC.
The determination of the Tribunal was as follows:-
There was no appearance by or representation on behalf of the respondent. The Tribunal notes the respondent’s correspondence of the 7th January 2016 in which it was put that a sum of €4,000.00 (four thousand euro) had already been paid to the claimant and that two post-dated cheques had been sent to cover the remaining amount of the Rights Commissioner award. The claimant accepted this.
The Tribunal makes a determination to the like effect as Right Commissioner Recommendation ref: r-132148-ud-13/JC that the respondent pay the claimant the sum of €7,500.00 (seven thousand five hundred euro) under the Unfair Dismissals Acts, 1977 to 2007, and €1,000.00 (one thousand euro) under the Terms of Employment (Information) Act, 1994 to 2012, ref: r-129972-te-13/JC. The Tribunal notes that €4,000.00 (four thousand euro) has already been paid to the claimant in respect of these awards.
