1. Deployment of Welders based at Portlaoise Sleeper Plant.
BACKGROUND:

The case before the Court concerns a dispute between the Employer and the Union on behalf of approximately sixteen of its members employed as welders at the Employer's sleeper plant located in Portlaoise.The dispute could not be resolved at local level and was the subject of a Conciliation Conference under the auspices of the Labour Relations Commission. As agreement was not reached, the dispute was originally referred to the Labour Court on the 25th August, 2015, in accordance with Section 26(1) of the Industrial Relations Act, 1990. A Labour Court hearing took place on the 6th January, 2016. The following is the Recommendation of the Court:
RECOMMENDATION:
The dispute before the Court relates to the deployment of welders based at the Portlaoise sleeper plant and the circumstances in which contractors are to be utilised.
The matter was the subject of a Conciliation Conference under the auspices of the Workplace Relations Commission in the course of which the putting in place of a protocol to address the issues in dispute was explored. However, no agreement was reached.
The Court recommends that the parties engage in further meaningful discussions on the issues that arise in this referral, with the assistance of the Workplace Relations Commission, if necessary, within a three month time frame. Should the parties fail to reach agreement, any outstanding issues can be referred back to the Court for a definitive recommendation.
The Court so recommends.
