This case came before the Tribunal by way of an employee appealing a recommendation of a Rights Commissioner under the Organisation of Woking Time Act, 1997, (ref: r-142144-wt-14) and a decision under the Payment of Wages Act, 1991, (ref: r-142142-pw-14)
The decision of the Tribunal was as follows:-
There was no appearance by the Liquidator. The Tribunal is satisfied that he was on notice of the hearing. The Tribunal heard evidence from the appellant. He was employed by the respondent from July 2010 until the 16th of May 2013 when he and other employees were dismissed without notice. He was not paid in lieu of notice and was owed one week’s wages.
Determination:
Having heard the uncontested evidence of the appellant the Tribunal awards him €770.00 (seven hundred and seventy euro) in respect of two weeks’ statutory notice entitlement and €385.00 (three hundred and eighty-five euro) in respect of one week’s outstanding pay under the Payment of Wages Act, 1991.
The appellant withdrew his appeal under the Organisation of Working Time Act, 1997, as he had already pursued this appeal through the Labour Court.
