This case came before the Tribunal by way of an appeal by the former employee (appellant) against the decision made by a Rights Commissioner reference r-135786-pw-13/DI.
Determination
The Tribunal is satisfied that all parties were on notice of the hearing. There was no appearance by or on behalf of the respondent.
This matter comes before the Tribunal by way of an appeal from the Rights Commissioners decision of the 21 February 2014. The appellant made an application under the Payment of Wages Act in respect of the non-payment of wages for a period from 7 May 2013 to the 11 June 2013.
The appellant was employed as an internet marketing specialist by the respondent company in December 2011. On the 7 May 2013 he was informed that his job was ceasing and he would receive his wages up to the 11 June 2013 as per his contract of employment. He never received payment. A liquidator was appointed to the respondent company on the 30 July 2013.
Based on the uncontested evidence the Tribunal find that the appeal succeeds and award the appellant the sum of €4807.70 under the Payment of Wages Act 1991.
