Determination:
On the first day of the hearing the respondent failed to attend. On the second day of the hearing a representative on their behalf was in attendance, however, no witnesses who could give sworn evidence on behalf of the respondent where present on either date. The respondent’s representative gave submissions of the respondent’s position.
The appellant gave sworn evidence of his employment history with the respondent company.
Having heard this sworn evidence and submissions the Tribunal finds that the appellant is entitled to a lump sum payment under the Redundancy Payments Acts, 1967 to 2007, based on the following criteria:
Date of Commencement: 2 August 2005
Date of Termination: 30 April 2014
Gross Weekly Pay: €251.00
NB: It should be noted the number of weeks the appellant worked in 2011, 2012 and 2013.
2011: week 10 to week 51 – worked a total of 41 weeks
2012: week 35 to week 52 – worked a total of 17 weeks
2013: week 20 to week 52 – worked a total of 32 weeks
The appellant was also on a period of lay off from: 20 December 2013 to 30 April 2014.
This award is made subject to the appellant having been in insurable employment under the Social Welfare Acts during the relevant period.
