The decision of the Tribunal was as follows:-
There was no appearance by the Liquidator of the respondent company. The Tribunal notes the correspondence from the Liquidator on file in regard to this appeal. The appellant has been paid her statutory redundancy entitlement through the Social Insurance fund and €1,863.00 in respect of minimum notice from the Insolvency Fund. The appellant contended that her weekly pay was €450.00 and that she is entitled to six weeks’ pay in lieu of notice having been employed from January 2001 until January 2014 and as such contended that she is entitled to a further €837.00. The appellant is also seeking €270.00 in respect of three days’ holiday pay under the Organisation of Working Time Act, 1997.
The appellant withdrew a concurrent appeal under the same Acts with the hearing number 59931.
Determination:
The Tribunal awards the appellant €837.00 (eight hundred and thirty-seven euro) under the Minimum Notice and Terms of Employment Acts, 1973 to 2005, and €270.00 (two hundred and seventy euro) under the Organisation of Working Time Act 1997.
The appeal under the Redundancy Payments Acts, 1967 to 2007, is dismissed.
