The decision of the Tribunal was as follows:
The Tribunal approved the amendment of the respondent as listed above as the Tribunal was satisfied that the respondent was properly served at the registered address.
The claim under the Redundancy Payments Acts was withdrawn at the outset of the hearing.
The appellant worked for the respondent from 13th May 2013, until 28th October, 2014 when the college closed without giving any notice to employees’. The appellant worked as a Student Welfare Officer and told the Tribunal that she did not receive her minimum notice entitlement.
With regard to the Organisation of Working Time claim, the appellant indicated that her claim was dealt with in another forum.
Determination
Based on the evidence adduced, the Tribunal awards the appellant her statutory entitlement of €570, being the sum due for one weeks’ notice, under the Minimum Notice and Terms of Employment Acts, 1973 to 2005.
As the claim under the Organisation of Working Time Act was dealt with in another forum, it was determined by the Tribunal that the claim could not be proceed before the Tribunal.
