These cases came before the Tribunal by way of an appeal by the employee (appellant) against the decisions of the Rights Commissioner (ref: r-148731-te-14/JT) under the Terms of Employment (Information) Act 1994 and 2001 and (ref: r-148587-tu-14/JT) under the Protection of Employees on Transfer of Undertakings Regulations 2003.

Determination

There was no appearance by or on behalf of the appellant and the Tribunal is satisfied that proper notice was sent to him.

Accordingly the appeals under the Terms of Employment (Information) Act 1994 and 2001 and under the Protection of Employees on Transfer of Undertakings Regulations 2003 fail for want of prosecution.

Both decisions of the Rights Commissioner are upheld.
