The determination of the Tribunal was as follows:-

This matter came before the Tribunal by way of the claimant seeking implementation of an Order of the Rights Commissioner dated 4^th February 2013.

The representative for the respondent told the Tribunal that the respondent had appealed the Order of the Rights Commissioner and had not withdrawn that appeal. The appeal was listed for hearing before the Tribunal and was withdrawn on the day of the hearing on the basis that a compromise had been reached whereby the claimant would return to work.

As there was no appearance by the personal representative of the claimant the matter fails for want of prosecution.
