The determination of the Tribunal was as follows:-
Background:
At the outset the respondent’s representative explained that the respondent company has ceased trading in this jurisdiction and its’ holding company in the United Kingdom did not proffer any witnesses to give sworn evidence in this matter but stated the claimant had been dismissed by reason of redundancy.
The claimant gave uncontested evidence of the reason given by the respondent for the termination of his employment after one year and five months service and his efforts to mitigate his losses.
Determination:
The Tribunal have carefully considered the evidence adduced. The claimant was unfairly selected for redundancy and in particular the respondent failed to communicate with the claimant in a manner the Tribunal would expect.
The Tribunal awards the sum of €15,000.00 (fifteen thousand euro) under the Unfair Dismissals Acts, 1977 to 2007.
