Procedure:

In accordance with Section 41(4) of the Workplace Relations Act, 2015 and following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint. 

The Complainant was employed from 13^th November 2013 until the employment terminated on 7^th September 2015. The Complainant was paid €10.00 an hour and she worked 15 hours on average a week. She was paid monthly into her Bank. She stated that she had worked 61 hours in August 2015 but was only paid for 52 hours. She worked for 15 hours in September 2015 but was not paid. She is claiming payment of 24 hours @ €10.00 an hour = €240.00

Decision

In accordance with Section 41 (4) of the Workplace Relations Act, 2015 and Section 6 of the Payment of Wages Act, 1991 and on the uncontested evidence of the Complainant I declare the complaint is well founded. I order the Respondent to pay the Complainant the sum of €240.00, subject to any lawful deductions, within 42 days of the date of this Decision.
