Procedure:
In accordance with Section 41(4) of the Workplace Relations Act, 2015 and under section 27 of the Organisation of Working Time Act, 1997 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background
The Complainant was employed as a Manager from 18th August 2014 to 15th August 2015. He was paid €2,000 per month. He has claimed that he is owed holiday pay.
This complaint was presented to the Commission on 22nd November 2015.
Findings
The Complainant did not attend and was not represented at the hearing.
I find that the claim fails for want of prosecution.
Decision:
Section 41(4) of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act and under section 27 of the Organisation of Working Time Act, 1997.
As per Sec 27 (3) (a) I have decided that as no claim was presented the claim fails for want of prosecution.
