Procedure:
In accordance with Section 41(4) of the Workplace Relations Act, 2015 and under Section 77 of the Employment Equality Act, 1988 following the referral of the complaint(s)/dispute(s) to me by the Director General, I inquired into the complaint(s)/dispute(s) and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint(s)/dispute(s).
Complainant’s Submission and Presentation:
On Tuesday 1st December 2015, I attended an interview for a part time sales assistant role. I was asked to complete a form specifically asking my age, marital status and how many children I had, in complete contravention of the equality law relating to family status, civil status and age discrimination. I completed this honestly (despite alarms bells ringing but hoping I would get the job) revealing information that did not impact upon the job. I did not get the job and I have not had feedback as to why I was unsuccessful. |
Decision:
Section 41(4) of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint(s)/dispute(s) in accordance with the relevant redress provisions under Schedule 6 of that Act.
Section 79(6) of the Employment Equality Act, 1998 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under section 82 of the Act.
Decision:
As the complainant was not present at the Hearing to present her case I deem the claim to be not well founded}
