Procedure:
In accordance with Section 41(4) of the Workplace Relations Act, 2015 and Section 8(1B) of the Unfair Dismissals Act, 1977 following the referral of the complaint(s)/dispute(s) to me by the Director General, I inquired into the complaint(s)/dispute(s) and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint(s)/dispute(s).
Background
The claimant commenced working for the respondent in September ’12.She worked 20 hours per week and was paid €8.65 per hour. The claimant submitted that issues had arisen within the workplace and that she was being held responsible by the respondent which was totally unfair. The claimant went on annual leave in July 2015 and when she returned holidays on the 18th July she discovered that the week’s roster did not have any hours for her.
It was submitted by the claimant she arranged a meeting with the respondent on the 27th July and she was informed through a work colleague that she was fired and “that’s it” and I would be getting my P45 soon. Through her solicitor she requested a written reason for her dismissal. The last day the claimant worked for the respondent was the 3rd July however her P45 was dated the 27th July 2015. The claimant submitted that she was denied fair procedures and a right of appeal.
Findings
The respondent did not attend.
The complaint was received on the 4th January 2016.
Decision:
Section 8(1B) of the Unfair Dismissals Act, 1977 requires that I make a decision in relation to the unfair dismissal claim consisting of a grant of redress in accordance with section 7 of the 1977 Act.
Based on the uncontested evidence I find the claimant was unfairly dismissed and I award her €2000 in compensation
